10 Celebrity Trademarks We Can't Believe Exist

$

tim tebowing broncos tebowing

Following news that NFL quarterback Tim Tebowtrademarked his "tebowing" prayer stance, we wondered how outlandish trademarks could really get.

Not surprisingly, the world of celebrities is full of history's most absurd trademarks.

Yes, in the United States you can own a trademark for almost anything including smells, colors, and sounds, and these celebrities have used that power to their advantage.

From Tim Tebow's "tebowing" to Rachel Zoe's "I die"— these trademarks really do exist.

'That's hot'

Owner: Paris Hilton

Paris Hilton filed the application for her "Simple Life" catchphrase in 2006. The mark, however, only applies to alcohol and clothing, according to the U.S. Patent and Trademark Office.

'Let's get ready to rumble'

Owner: Michael Buffer

The boxing announcer's decision to trademark his catchphrase in 1992 was massively profitable. By selling the rights to his mark to movies and video games makers, he has made more than $400 million, ABC News reported in 2009.

Tebowing

Owner: Tim Tebow

The NFL player registered his trademark for bowing down on one knee with your fist to your forehead in October 2012.

The New York Jets backup QB swears he's not trying to make money off the mark, though. He says he just wants “to just control how it’s used, make sure it’s used in the right way," The Washington Times reported.

Business Insider's 10 Worst Ads of 2012

$
0

alibi bourbon

In 2012, some of the worst ads aired had a theme: an overwhelming sense of self-importance. Insisting that everyone take you as seriously as you take yourself can be fatal for brands -- as this ranking shows.

Sure, there are a couple of awful local ads, as always. But you'd be surprised at the big brands who dropped stinkers this year, too. Companies that should have known better, like Harvey Nichols, Chanel and Sidney Frank all made our list.

See the best ads of 2012 here, to get an idea of how high the standard ought to be. And then see what the bottom of the barrel looks like.

10. Stanley Steemer: "Rock 'n Roll carpet," by Young & Laramore

Opening your front door to find Twisted Sister's Dee Snyder screaming at you is most consumers' worst nightmare. And Snyder looks less than enthusiastic about it in a closeup at the end of the spot, too. But Stanley Steemer believes it's a selling point. The entire thing stinks of, "who's the most famous person we can get for the least amount of money, regardless of how irrelevant they are to the carpet cleaning business?"

9. Chanel No. 5: “There you are,” by Joe Wright.

On paper, the concept is wonderful: Brad Pitt looks women in the eye and tells them exactly what they want to hear. The execution, however, was all wrong. Pitt seems distracted by the weird script he's been given. The monologue alone isn't enough to sustain the concept. (In fact the ad was later recut to add a female character). And the entire thing collapses under the weight of the conceit it is supposed to sustain. Luxury brands need to be taken seriously so that you forget that all they're doing is selling ephemera. But take yourself too seriously, and no one else will -- which is why this ad became an SNL parody days after it was aired.

8. Sydney Frank/Jagermeister – "Uncommon Men," by Mistress

Jagermeister is the rodeo clown of the drinks world. No one drinks it because they like it, but sometimes it's not really a party until someone yells "Let's all do Jager shots! Whoo!" Jager's challenge, therefore is to solidify it's place as America's premier party drink without acknowledging the fact that no one takes it seriously. Some self-effacement was in order. Instead, the brand made the disastrous decision to use an actual rodeo clown as its brand's hero, and to insist that men can only qualify to drink the stuff if they're as manly as he is. The result: a hot mess of laugh-out-loud pomposity. (And, presumably, the alienation of its female customers).

Mark Cuban started his working life as a bartender in Dallas. Then he took a job as a computer salesman.

Then he was fired.

And only then did he start his first company, MicroSolutions. He did well, selling it for $6 million.

He did even better with his next company – about 1,000 times better. He created a company called Broadcast.com, and sold it to Yahoo for almost $6 billion.

Almost immediately, Cuban sold all of his Yahoo stock netting $2 billion in cash for himself. His timing was impeccable. Weeks later, the market crashed.

Since then, Cuban has continued to work and invest. He's the champion owner of the Dallas Mavericks. He owns HDNet, too. He's a reality TV regular – appearing on shows like Shark Tank and even Dancing With The Stars.

All the while, Cuban has had a lot to say. Due to his incredibly impressive career, it's worth listening to him.

The 9 Most Epic Rick Santelli Flip Outs Of All Time

santelli

CNBC's colorful and outspoken correspondent Rick Santelli never ceases to amaze with his epic rants and on air meltdowns.

Santelli, who is perhaps most famous for his February 2009 "Tea Party" rant, recently blew up at CNBC colleague Steve Liesman over the fiscal cliff issue and walked off camera on live television.  Talk about making some great TV!

We've compiled some of our favorite Santelli's flip-outs and on air antics of all time.

He is best known for his famous 'Tea Party' rant from February 2009 when he expressed his outrage over people subsidizing their loser neighbor's mortgages. CME traders then started applauding in the background.

Last week, Santelli flipped out at Steve Liesman over two op-eds in the WSJ. Santelli told Liesman, 'Don't give me the switcheroo!' and later said 'I can't even talk about it anymore' and walked off camera on live TV.

Santelli and Liesman seem to have a history of fighting on air. In December 2009, when they were arguing over emergency claims benefits Santelli told Liesman, "You don't say anything I find interesting." Ouch!

Gold continues to fascinate.

Purchases of the physical metal have been surging, while prices have been weak.

There are two competing storylines. One posits that developed economies, mired in debt, and trapped in a race to debase will continue to boost gold.

The other story is that a deflationary environment could boost the demand for cash, causing people to sell the yellow medal.

Our friends at Waverly Advisors -- which has recently become a research provider to Interactive Brokers -- has put together a great deck on the bull case and the bear case for gold.

Outside of the Jets (finally) benching Mark Sanchez and three of the six AFC playoff spots being locked up with 25% of the season left to play, it was a rather quiet Sunday in the NFL. But as usual, there were still some entertaining and interesting moments.

From Greg Schiano patting Peyton Manning on the helmet, to Sidney Rice getting knocked out cold and the best touchdown celebrations, we have narrowed down the best highlights.

These Are The 5 Most Over-Hyped Mars Discoveries

$

mars

NASA has been trying to dampen expectations for an upcoming Mars announcement after rumors abounded that the agency's Curiosity rover discovered something big.

"Rumors and speculation that there are major new findings from the mission at this early stage are incorrect," NASA officials wrote in a statement on Thursday (Nov. 29). "The news conference will be an update about first use of the rover's full array of analytical instruments to investigate a drift of sandy soil."

The announcement will be made at the Fall Meeting of the American Geophysical Union in San Francisco on Monday (Dec. 3).

In light of this latest saga, we took a look back at the five most overhyped Mars discoveries in years past.

1. Canals on Mars

One of the most famous, and famously wrong, discoveries about our neighboring planet was the 1870s claim that canals had been dug into the Martian crust, thus "proving" the existence of life on Mars.

Prominent astronomer Percival Lowell popularized the canal theory, based on the notion that Mars was once green and wet, but had lately been drying out, so the Martians had engineered canals to route water down from the planet's polar ice caps. [The Search for Life on Mars (Photo Timeline)]

Historians say the canal frenzy was boosted by the widespread excitement over the construction of the Suez Canal, an engineering marvel that was completed in 1869.

The idea of canals on Mars persisted well into the 20th century, until observation technologies were advanced enough to reveal the canals as an optical illusion.

2. Flowing water on Mars

On June 22, 2000, NASA announced it had found evidence for liquid water currently flowing on the surface of Mars.

The news, based on photos of gullies etched across the Martian surface taken by NASA's Mars Global Surveyor, made a big splash.

The gullies seemed to have been formed by flowing water, and debris and mud deposits nearby suggested liquid water as well.

What's more, researchers at the time judged the structures to be freshly formed, implying that liquid water exists on Mars today.

However, in the more than 10 years since the announcement, scientists have yet to confirm the gullies are caused by flowing water, or offer definitive proof of water on Mars today.

While experts mostly agree that water ran over Mars' surface in the ancient past, there is lingering disagreement over the present day.

3. Face on Mars

A black-and-white photo of Mars taken by NASA's Viking 1 orbiter in 1976 quickly captivated the public because it revealed an eerie likeness of a human face on the planet's surface.

Although NASA scientists just as quickly judged it to be a naturally occurring outcropping of rock, accentuated by light and shadow, many people searched for a deeper explanation.

Some fixed on the idea that the formation was constructed by an alien civilization, and looked for further signs of a crumbling extraterrestrial city in the region.

The "face on Mars" has been imaged in higher resolution by subsequent NASA missions, which have bolstered the optical illusion explanation.

Still, the uncanny allure of the structure has never totally faded. [Photos: The 'Face on Mars' and Other Illusions]

tivoli gardens

Walt Disney had a dream of creating a "great, great playground for the children and families of America."

He traveled to Tivoli Gardens, one of the world's oldest amusement parks located in the middle of Copenhagen, for inspiration.

Unlike other "seedy" amusement parts of the day, Tivoli was a "a clean and orderly park in Copenhagen ... with 'lush flowers, tame rides' and a festive family atmosphere," Andy Boynton and Bill Fischer wrote in their book The Idea Hunter: How To Find The Best Ideas And Make Them Happen.

According to radio and TV personality Art Linkletter, who recalled his 1951 trip to Tivoli with Disney in the book, Disney walked through the amusement park scribbling down notes about the seats, gardens, rides, food, and every other detail he noticed.

Disneyland opened in California four years after the trip.

Welcome to Tivoli Gardens, in the heart of Copenhagen.

About four million tourists visit Tivoli every year.

Mountain Cars For Ski Bums On A Budget

subaru legacy

After a long slowdown, auto sales have made a comeback.

According to Zacks Investment Research, in September 2012, 14.9 million vehicles were sold, and that was the highest monthly number since March 2008.

Check out these mountain-ready cars >

If you're looking for a new car and you and your family crave the ski slopes or frequently take trips to the mountains, Bankrate has come up with five great vehicles for you.

Several factors were considered when deciding on these selections:

  • Performance.
  • Cost.
  • Safety.
  • Cargo capacity.
  • Other winter weather features.

We queried our friends at Edmunds.com, the car experts, for suggestions. Then Bankrate narrowed the list down to five fabulous mountain cars for winter driving.

Here's a secret to keep in mind when shopping: "A good set of snow tires and a dash of driver's common sense will get just about any front-wheel-drive vehicle most places that an all-wheel-drive model will go when the snow flies," says Bill Visnic, a senior editor at Edmunds.com.

Here are our choices listed according to base price, with the least expensive first.

Subaru Legacy

Base price: $20,295
Gas mileage: City — 21 mpg, Highway — 28 mpg

The 2013 models are available in four-cylinder or six-cylinder engines.

Subaru says the Subaru Legacy handles better and drives more smoothly than in previous years, making it one of the most reasonably priced mountain cars.

Performance: This is the only car in its class to offer all-wheel-drive as standard equipment, which helps with making a quick response in slippery conditions.

The car's stability control helps keep it on the driver's intended path.

Safety: The car's EyeSight system, an option on some models, comes with two cameras mounted on the rearview mirror and alerts the driver if the car wanders out of its lane or if the driver should brake to avoid a collision.

Four-wheel antilock brakes come standard on the Subaru Legacy model.

Cargo capacity: The cargo volume is 14.7 cubic feet, and the rear seat folds completely down or you can split it, allowing you to carry large items and one passenger at the same time.

Features: A dual-zone climate control lets the driver and passenger set their own ideal temperatures. Heated seats, a ski attachment and accompanying hardware that holds six pairs of skis can be added.

Ford Taurus

Base price: $26,600
Gas mileage: City — 19 mpg, Highway — 29 mpg

A new hood design and bold new grille plus a wide stance and refined suspension mark the major changes to the new Taurus.

Performance: A four-cylinder engine combines direct injection with a turbocharger, making the Taurus comparable to a car with a V-6 engine.

Front-wheel-drive comes standard, but you can opt for all-wheel-drive. Antilock brakes and Curve Control, which slows the car when it senses you're cornering too fast, come standard on all models.

Safety: Projector-beam halogen headlamps focus more light in front of the car, giving the driver greater visibility. Adaptive cruise control monitors traffic ahead and automatically adjusts speed to maintain a safe distance.

Cargo capacity: The Taurus seats five. The trunk measures a generous 20.1 cubic feet, and for even more room, the rear seat folds forming a 60/40 split.

Features: Ford Taurus comes with 10-way power adjustment for the driver and front passenger seats, and optional heated front passenger seats, and optional heated front and rear seats — perfect after a day on the slopes.

Jeep Grand Cherokee

Base price: $27,495

Gas mileage: City — 17 mpg, Highway — 23 mpg

Performance: You have three four-wheel-drive systems to choose from.

Hill Descent Control with grade sensing allows a controlled hill descent on rough terrain, while Hill Start Assist helps when starting from a stop on a hill.

This near-luxury crossover offers a spacious interior, a standard 3.6-liter 24-valve V-6 engine and an optional all-wheel-drive system with five different settings including "snow," a great option for mountain cars.

Safety: Dual radar sensors monitor blind spots. Driver- and passenger-seat-mounted pelvic and thoracic air bags are standard.

Cargo capacity: Standard towing capacity is 5,000 pounds. Cargo space behind the second row is 35.1 cubic feet. With rear seats folded down, it's 68.7 cubic feet.

Features: Grand Cherokee's Quadra-Lift Air Suspension adds up to 4.1 inches of lift supported by four-corner air springs for a smooth ride. Heated front and rear seats are optional.

6 High-Tech Cars That Would Make James Bond Jealous

$

bond 007 skyfall aston martin db5 history

These days, your car is more than just a means to get from point A to point B.

It's a roaming smartphone and computer. From technology that will automatically tweet your location to systems that will park your car for you, technology is increasingly becoming standard in vehicles.

Check out these envy-inducing cars >

Some options drivers can expect to get include in-car entertainment systems, many of which boast at least 8-inch LED screens that control all aspects of the car, night-vision systems that increase your visibility beyond your headlights and emergency brake-assist technology that can sense when a panic-braking situation is occurring.

But not all cars are created equal. There are those standout high-tech cars and trucks that have so much built-in technology, you'll think the car manufacturer has James Bond on staff.

The technology isn't only reserved for high-end vehicles. There are reasonably priced cars that compete with the big boys when it comes to technology.

With that in mind, here's a look at six vehicles that will impress even the most tech-savvy drivers.

Mini Cooper S Coupe

MSRP: $25,450
Gas mileage: City — 27 mpg, Highway — 35 mpg

The Mini Cooper S Coupe may not be on the top of the list of sports cars or luxury cars, but this car is a hands-down heavyweight when it comes to technology.

While in-car entertainment systems are commonplace these days, the unique placement of it in the 1.6-liter four-cylinder Cooper S sets this car apart.

A 6.5-inch high-definition display is embedded in the center of the speedometer. The car comes equipped with Bluetooth, the ability to integrate your smartphone into the system and a USB/iPod adapter.

Drivers can control the system using the car's joystick, voice activation or steering wheel buttons.

You won't have to worry about bringing your car charger with you when driving the Cooper S because there's a phone charger in the center armrest.

Need to access Facebook, Twitter, Google or Web radio while you're on the road? Download the free Mini iPhone app.

Cutting-edge technology isn't only reserved for the cabin of the Cooper S.

To take your Cooper on the open roads, pop it into sport mode, and it will automatically adjust settings to give you rapid acceleration, response and tighter steering.

Audi S5 Coupe

MSRP: $50,900
Gas mileage: City — 18 mpg, Highway — 28 mpg

The Audi S5 Coupe isn't only for serious drivers.

It's also a must-have for anyone looking to blend technology and style.

Music lovers will applaud the 14-speaker Bang & Olufsen sound system that comes with the Premium Plus package in this 3-liter six-cylinder 333-horsepower sedan.

Audi's optional noise compensation technology enables sound volume to stay constant no matter how loud the road conditions are or how fast you're driving.

Audi's MNI Navigation Plus system includes a full-color LCD screen, voice activation, real-time traffic information and three-dimensional topographic data.

Audi Connect brings high-resolution, three-dimensional terrain and aerial imagery through a first-to-market integration of Google Earth.

The navigation system acts as a Wi-Fi hot spot for up to eight electronic devices. The Audi S5 isn't shabby when it comes to safety technology, either. Its optional side-assist technology can detect cars in your blind spot.

Ford Fiesta SE Sedan

MSRP: $15,200
Gas mileage: City — 29 mpg, Highway — 39 mpg

In addition to getting almost 40 mpg on the highway, the 1.6-liter four-cylinder Ford Fiesta SE Sedan comes with Sync with Sync AppLink.

The technology gives you the ability to access Internet content, listen to your favorite Internet music, hear incoming tweets, make phone calls hands-free and have incoming texts read aloud to you.

Whoever said good things come in little packages was spot-on with the Ford Fiesta, when it comes to technology. What the Fiesta lacks in speed and style, it makes up for in cutting-edge technology.

With the system's voice-activated music search feature, all you have to say is what or whom you want to hear, and seconds later it will be blaring out of your sound system.

The Sync Services gives you turn-by-turn directions, sports scores, news and other entertainment information.

Denny's has dubbed it the "Diner of the Future," and it has all sorts of features that you won't find at a regular Denny's spot.

Everything is set to go at the diner except for one thing — the wedding chapel. Yes, it's going to have a wedding chapel. Denny's wants to get that section up and running by Valentine's Day, according to Eater.

Welcome to the ridiculously bright Denny's flagship in Vegas. It's very yellow.

"A normal Denny's is not going to cut it in Vegas," CMO Frances Allen told Reuters. Well, she definitely went all out with this one.

How A Startup Scored A Happy Meal Deal With McDonald's 14,000 US Stores

mcdonalds happy meal kid

Mind Candy, a UK-based social network for kids and the brand owner of Moshi Monster toys, just landed a Happy Meal partnership with McDonald's.

The startup's licensed products will be placed in more than 14,000 stores across the United States this holiday season, from December 14 through January 10.

How do companies get their products in Happy Meals? And who pays for the thousands of trinkets that go in every kid's box?

We asked Mind Candy's chief business-development and licensing officer, Darran Garnham, how he got the deal done.

Research what McDonald's is doing before you reach out.

McDonald's is the world's largest toy producer, and it also supports a lot of entertainment brands, says Garnham.

His team noticed McDonald's recent focus on McWorld, a website the food chain has been pushing. Since Moshi Monsters is both an online social network and a toy maker, Garnham pitched it to McDonald's as a perfect fit for its brand.

Does your brand share McDonald's values?

McDonald's is a family brand. If you're promoting something off the wall, it's probably not a good fit for the fast food chain.

"McDonald's is an iconic American brand that values family, education and safety," says Garnham. "Mind Candy holds many of the same values, and we felt this was a crucial component in developing a successful promotion and partnership."

Be patient. The Mind Candy-McDonald's deal took two years.

It took Mind Candy two years to land a deal with McDonald's.

Garnham says discussions began in 2010.

"The planning and implementation of the program as well as the window for the promotion to take place are all carefully considered," he says.

The 10 Weirdest Cars Made In China

$
0
0

weird china cars

As China settles into its role as the world’s largest car market, domestic car manufacturers are working overtime to find ways to satiate the needs of the country’s increasingly mobile populace.

Unlike the West, however, China’s car market doesn’t have the 100+ years of automotive history we benefit from, which leads its domestic car manufacturers to build some, well, interesting vehicles.

Though China’s car industry has evolved past carts powered by lawnmower engines, it still produces vehicles that leave us Westerners a bit dumbfounded.

Here are 10 modern Chinese cars that leave us scratching our heads.

Great Wall Hover Pi

Great Wall’s Hover π (yes, that is the pi symbol) is a stretch-limo SUV that you can buy from the factory, and, yes, the interior is a combination of horrid plastics and the terrible décor of a 1980s hotel.

But this is China, where the ultimate display of wealth is having someone else do the driving for you.

So while the Hover π may look like a cheap prom-night special to us, it surely carries some status in its native land.

BAW Motors Yongshi

“Unusual” doesn’t always equal “bad.”

Take, for example, BAW Motors’ Yongshi (“Warrior”). Looking a bit like a cross between a Humvee and a Range Rover, the Yongshi is a military-grade off-road machine.

It’s not the most powerful off-roader around, but it is solid enough to be used by the UN.

English-language promo photos show the Yongshi solely as a military machine, but as the Chinese consumer site touts its five-passenger seating capacity and CD player, we’re sure that anyone with the cash — which does usually mean some sort of government official — can buy one.

Haima Auto Happin

Conflicted car buyers who long for a 1999 Mazda Protégé but find it a tad too attractive and too powerful should be stoked on Haima Auto’s Happin sedan.

Haima Auto is a joint venture between China’s First Auto Works (FAW) and Mazda, so it’s safe to say that the Happin is made from genuine — if not ancient — Mazda tooling.

What perplexes us about this car, though, is that Haima also sells its own version of the Mazda3 — the successor to the Protégé and a much better, much more attractive car.

The Happin does only cost 60,000-70,000 yuan, which, for the equivalent of only $9,500-$11,000, gets you a 1.5 liter engine with a whopping 112 hp and 108 lb-ft of torque.

yoko ono john lennon clothing line

Yoko Ono created a bizarre men's clothing line, inspired by John Lennon's "sexy bod," for Opening Ceremony that includes hand prints on the crotch, mesh shirts, "Lightbulb bras," and bottomless trousers.

Apparently Ono has been sitting on these masterpieces for 43 years.

"I was inspired to create ‘Fashions for Men’ amazed at how my man was looking so great. I felt it was a pity if we could not make clothes emphasizing his very sexy bod,” she told Women's Wear Daily.“So, I made this whole series with love for his hot bod and gave it to him as a wedding present. You can imagine how he went wild and fell in love with me even more."

The clothes range from $75 to a whopping $750.

We've singled out the most outrageous.

The line's staple piece is the "hand trousers" for $335.

Which can be dressed down with a wide array of "mesh cutout shirts," costing $145 each.

Or dressed up with this $595 "hand jacket."

We're a nation of shopaholics, with Sex and the City's Carrie Bradshaw (obsessed with shoes and designer labels) and How I Met Your Mother's Barney Stinson (obsessed with suits and luxury goods) representing on our television sets what two of America's estimated 18 million shopaholics might look like in real life.

So where do all these shopaholics live? We looked at the top 100 cities in the U.S. by population to see which cities have households spending the most on clothes, shoes and other wear.

The spending data, which comes from the US. government, from anonymous and aggregated spending transactions from Citi, and third party data providers, was tracked for a full year from March 2010 to March 2011. Cities were then ranked by highest average monthly spending.

The most shopaholic city: Washington D.C., our nation's capital. Travel guide Fodor's says that the number of designer boutiques in the city is on the rise, and tourists can't resist picking up a few souvenirs when visiting the place where our nation's laws are passed, including African-inspired clothing, accessories, and art.

And as we all know, D.C. is a metro area run by people in suits, and suits aren't cheap, especially if they're designer. And you can bet on seeing very fine suits in Congress — half of our leaders in Congress are millionaires.

10. Bakersfield, California

Residents average monthly spending in clothes, shoes and other wear: $201.50

9. Austin, Texas

Residents average monthly spending in clothes, shoes and other wear: $213

8. Seattle, Washington

Residents average monthly spending in clothes, shoes and other wear: $221.17
